The Police have booked a case against the auto driver who has recorded the rape and sexual harassment incident that occurred in Visakhapatnam on October 22nd.
The auto driver of Visakhapatnam whose name is Sreenu was testimony to the horrific incident that took place in broad daylight. He has filmed the sexual harassment of the helpless woman in entirety. He has then transferred the recorded video to the Watsapp number of city police. the case is booked against him under Section 354 C and IT Act 67 A.
The Section 354 C of IPC elaborates as – “Any man who watches or captures image of a woman engaged in a private act under circumstances where she would usually have the expectation of not being observed either by the perpetrator or by any other person at the behest of the perpetrator or disseminates such image shall be punished on first conviction with imprisonment of one to two years.”
The IT Act 67 A elaborates as – ” Punishment for publishing or transmitting of material containing sexually explicit act in electronic form.”
The major issue here is of the auto driver transferring the video to not just the police but also to other media sources and unauthorized persons. While the video has been taken in as evidence and helped the police in identifying the man, questions are being raised as to why the auto driver of Visakhapatnam did not stop or attempt to stop the sexual harassment of rape perpetrated by Ganji Siva.
